PORTLAND, Ore. (AP) — The Oregon Court of Appeals overturned the conviction of a part-time bookkeeper found guilty of embezzling more than $200,000 from her employer.
The court sent the case against Kristina Kaino-Smith back to Clackamas County Circuit Court for a new trial because recorded statements from her husband were hearsay and shouldn’t have been heard by jurors.
The Oregonian reports Kaino-Smith and her husband worked for a Milwaukie car dealer. Prosecutors said Kaino-Smith forged the owner’s name on 111 checks, and used the money to pay for vacations, spa visits and other gifts.
Kaino-Smith denied wrongdoing, but the jury convicted her of theft and forgery. She was sentenced to more than three years in prison.
